Protecting Visitor (“Visitors” “You” “Your”) private information is our priority. This Privacy Policy (Hereafter known as “Privacy”) applies to NinePatch, Inc. (“Company”, “We”, “Our”) website (Hereafter known as “Site”) and governs data collection and usage. For the purposes of Privacy, unless otherwise noted, all references to NinePatch, Inc. (Hereafter known as Company) include the Site. By using the Site, you consent to the Privacy data practices described herein.

Collection of Visitor Personal Information

To better provide you with products and services offered on the Site, the Company may collect certain personally identifiable information from you (hereinafter referred to as “Visitor Personal Information or VPI”).  Visitor Personal Information may include your:

–             Phone Number

–             Job Title

In addition, Visitor Personal Information may include anonymous demographic information or other information collected such as:

–             Gender

–             Household Income

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain functionality available on the Site. This may include: (a) registering for an account on our Site (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; and (d) sending us an email message. We will use VPI for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

Use of Visitor Personal Information (VPI)

The Site may collect and use VPI to operate its customer relationship management, marketing or other software application to best deliver Site functionality.

Sharing Information with Third Parties

Company does not sell, rent, or lease NPI to third parties.  Company may share certain VPI with trusted partners to help perform statistical analysis, send emails or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using VPI except to provide these services to the Company and are contractually required to maintain the confidentiality of such information.

Company may disclose VPI, without notice, if required to do so by law or in the good faith belief that such disclosure is necessary in our reasonable determination to: (a) conform to the edicts of the law or comply with legal process served on Company; (b) protect and defend the rights or property of Company; and/or (c) act under exigent circumstances to protect the personal safety of visitors to the Site.

Tracking Visitor Behavior

Company may keep track of the Site pages you visit. This data is used to deliver customized content to visitors whose behavior indicates an interest in a particular subject area.

Automatically Collected Information

Information about a Visitor’s computer hardware and software may be automatically collected by Company. This information can include: the Visitor’s IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the Site to maintain quality of the service, and to provide general statistics regarding use of the Site.

Use of Cookies

The Site may use “cookies” to help personalize a Visitor’s online experience. A cookie is a text file that is placed on the Visitor’s hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to a Visitor’s computer. Cookies are uniquely assigned to Visitors and can only be read by a web server in the domain that issued the cookie.

One of the primary purposes of cookies is to provide a convenience feature to save time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize Company Website pages, or register with other services, a cookie helps Company to recall this information on subsequent visits. This simplifies the process of recording certain personal information, such as billing addresses, shipping addresses, and so on. The Site contain links to other sites. We are not responsible for the content or privacy practices of such other sites. We encourage our visitors to be aware when they leave our Site to read the privacy statements of any other site that collects personally identifiable information.

Security of Visitor Personal Information

Company secures VPI from unauthorized access, use, or disclosure. When such information is transmitted to other websites, it is protected using encryption via Secure Sockets Layer (SSL) protocols.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of VPI. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect VPI, by accessing and using the Site you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of all information and data exchanged between you and us through the Site cannot be guaranteed.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your VPI from our records; and
  • Direct any of our service providers to delete your VPI from their records.

Please note that we may not be able to comply with requests to delete your VPI if such information it is necessary to:

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for any such activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Allow the exercise of free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent for such use;
  • Enable solely internal uses that are reasonably aligned with visitor expectations based on the visitor’s relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use Visitor Personal Information internally in a lawful manner that is compatible with the context in which it was provided.

Children Under Eighteen

The Site is not intended to be used by children under the age of eighteen.  Company does not knowingly collect personally identifiable information from children under the age of eighteen. If you are under the age of eighteen, do not use or provide any information on the Site without permission from your parent or guardian.  If we learn we have collected or received personal information from a child under the age of eighteen without verification of parental consent, we will delete that information. E-mail Communications

From time to time, Company may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication.

If you would like to stop receiving marketing or promotional communications via email from Company, you may opt out of such communications.

External Data Storage Sites

We may store VPI on servers provided by third party hosting vendors with whom we have contracted.  Third parties are prohibited from using VPI except to provide these services to the Company and are contractually required to maintain the confidentiality of such information.

Changes to Privacy

We will notify you about significant changes in the way we utilize VPI by posting a notice on the Site.  Your continued use of the Site and/or services available through this Site after any such modifications will constitute your acknowledgment of the modified Policy and agreement to abide and be bound by Privacy.
